Victory in The United States Supreme Court!

On June 26, 2008, by a vote of 5-4, The United States Supreme Court ruled that the Second Amendment to the United States Constitution guarantees a fundamental, INDIVIDUAL right to own a firearm.

Voting with the majority were Chief Justice Roberts, Justice Alito, Justice Thomas, Justice Kennedy, and Justice Scalia, who wrote the opinion. Justices Breyer, Ginsburg, Souter and Stevens voted to uphold D.C.’s complete gun ban.

"The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditional lawful purposes, such as self-defense within the home."

Buckeye Firearms Foundation, together with a coalition of private security companies, filed an amicus brief in support of Mr. Heller.

With this decision, the Court signaled an unequivocal end to the two-decade legal charade popularly referred to as the "collectivist theory." Your right to possess a firearm in your own home is an individual right and has nothing to do with your role, or lack of role, in any militia.

Prior to today’s decision, the majority of the federal court circuits had utilized the collectivist theory, mostly as a means to uphold criminal convictions for violations of federal firearm laws. Clearly bad facts make bad law, and today’s decision is the reprieve gun owners have been looking for.

Governor Strickland signs SB184, Ohio's Castle Doctrine Law

Buckeye Firearms Association Chairman Jim Irvine, Legislative Chair Ken Hanson and several other Leaders were on hand Tuesday for the signing of SB184, Ohio's Castle Doctrine Law, by Democrat Governor Ted Strickland.

Strickland called the bill “common-sense legislation”, and stressed that it will also clear up ambiguous sections of Ohio's concealed-carry law.

“What we've clarified in this bill I think will go a long way toward providing both law enforcement as well as law-abiding citizens some confidence that what they're doing is, in fact, consistent with the law,” he said.

Victim Zones: We have to move the goal posts

Two more businesses where legal concealed carry is banned were robbed last week in Ohio. A BMV office on the east side of Columbus (a victim zone by statute) was robbed on the same day as a branch of Fifth Third Bank, which is a "gun free" zone due to the company’s private policy.

Clearly, it doesn’t matter why concealed carry is forbidden at a location, because the results are usually the same. Only the criminal will be armed despite the signs or laws that ban ownership of firearms to people with a felony conviction. In both of these cases the patrons were left at the whim of a street thug because honest people follow the law and criminals don’t.

I often look at books and studies relating to hunting, trapping or Second Amendment issues. Some are saved for possible reference; most are skimmed and discarded, while occasionally the author really grabs my attention. Perhaps this is because the author is breaking new ground, presenting the facts and conclusion in a fresh manner, or even just reaffirming values that were passed from my ancestors to me. Rarely does the author combine all these facets into one work. That is exactly what Dr. Randall Eaton has done with his ongoing study of animal and human behavior combined with hunting.

10TV: Women's Shooting Clubs Becoming More Common

Columbus' CBS affiliate, WBNS 10TV, is reporting that female enrollment in handgun classes is at an all-time high and protection is the top motive.

The number of women who carry handguns is rising across the U.S., according to the National Shooting Sports Foundation.

Florida law solving the Parking Lot Ban takes effect

A law that protects the right of Floridians to keep their guns locked in their personal vehicles at work took effect on July 1. HB503 will prevent employers from searching cars and firing employees for having guns or a concealed weapons license.

Too often people in other states look to Florida’s good firearms laws and wish we could pass good laws so easily. It’s not always as easy as it seems.
