Toledo homeowner fights back during attempted home invasion

WTVG (ABC Toledo) reported recently that a man defended himself and his girlfriend when a man forced his way through a window in an attempted home invasion.

A Toledo man is recovering after he was shot, possibly during an attempted home invasion, Thursday morning.

Antione Garrett told police he and his girlfriend woke up to the sound of someone breaking into their home on the 3600 block of Laybourn.

He told investigators, when the suspect came in through a window, Garret fired a handgun at him multiple times, and the crook took off.

A short time later, Toledo firefighters were called to a home in the 3700 block of Burton, not far from the original call on Laybourn.

That's where they found Randy Estrada, 21, with gunshot wounds. They took him to Toledo Hospital for treatment. He is expected to recover.

Officials have yet to officially connect Estrada to the break-in. At this time, there's no word on if he will be arrested or charged with anything.

Under Ohio's Castle Doctrine law, which took effect in 2008, if someone unlawfully enters or attempts to enter the owner's occupied home or temporary habitation, or occupied car, citizens have an initial presumption that they may act in self defense.
