Toledo CHL-holder defends self against armed felon

WTVG (ABC Toledo) reported recently that no charges will be filed against a man who shot and killed an armed 26-year-old felon, Jomar Quinn Martin. It happened at Royale Place, a bar on Airport near Wenz just before 1:00 a.m. Wednesday, November 13.

"There was an argument in the parking lot and that's all we feel comfortable saying at this time," said Sgt. Joe Heffernan.

The coroner says Martin was shot three times - once in the head, torso and left arm. Police say they will not charge the man who killed Martin.

"The person who that shot him was a CCW holder and made contact with us immediately. At this time after getting the preliminary evidence we have the prosecutors office has decided not to charge the CCW holder in the death of Mr Quinn-Martin. He was possession of a fire arm," said Sgt. Heffernan.

Police aren't releasing the name of the CCW holder, but say he is cooperating with detectives and he's given them his gun. It's likely the case will be presented to the Lucas County Grand Jury to determine if any charges will be filed.

The shooting victim is no stranger to Toledo police. According to court records he has a long criminal history. Police say Martin had a gun on him last night.

Court documents show Martin is a convicted felon and should have never had a gun. He was scheduled for an arraignment later that same day in Lucas County Common Pleas court. In July he was charged with carrying a concealed weapon and receiving stolen property after he was caught with a stolen gun. The gun was stolen from a Toledo police officer's apartment.
