NRA-ILA lawsuit challenges new Delaware permit-to-purchase law

NRA-ILA on May 19 announced a lawsuit challenging Delaware’s new permit-to-purchase law. The permit-to-purchase law requires Delaware residents to obtain a “Handgun Qualified Purchaser Permit” before purchasing a handgun.

On May 9, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit published a split decision vacating the conviction of Steven Duarte for violating 18 U.S.C. § 922(g)(1). Given the history of the Ninth Circuit, it is almost certain the government of California will ask for an en banc (all judges) review of this case. En banc is likely to be granted.
